Data Protection Statement

Data protection and data security for my customers and suppliers have a high priority for me, Robert Kerns, freelance technical translator and sole operator of the website www.RobertKerns.de.

With this Data Protection Statement, I wish to advise you of the nature, scope and purpose of the personal data collected, used and processed by me. I also wish to advise you of your rights.

1. Contact Data

2. Data Subjects

Customers/clients, prospective customers, contractual partners, suppliers, providers of goods and services, other communication partners and other visitors to my website.

3. Collected and Processed Data

a) Data in conjunction with quotations and orders
I collect, process and store the data that you provide to me when you request a quotation from me for translation work and/or when you task me with translation work. I also store and process data in respect of the execution of the order and the timeliness of the subsequent payment.

The following data and data categories are collected and, where necessary, processed:

-     Surname, forename, title, form of address (gender), company name

-     Address data (town/city, postcode, street, house number, and any other components of the address)

-     Contact data (e.g. telephone number, e-mail address)

-     Payment data

-     Source texts, reference documents, style guides and similar material

-     Payment history data.

b) Log data
I collect no data when you visit my website. Log data is, however, collected by my webhosting provider, currently STRATO AG - Pascalstrasse 10 - 10587 Berlin, when visitors access my website. According to STRATO, host names and IP addresses are anonymised in the logfiles for data protection purposes, and the anonymised data in respect of visitors to my website are stored for a maximum of 7 days for detection of and defence against attacks.

c) Cookies and tracking & analysis tools
My website uses neither cookies nor tracking & analysis tools such as Google Analytics.

d) Data related to suppliers and providers of goods and services
I process the data provided to me by suppliers, providers of goods and services, and other parties in communication with me. This data includes, for example, names, addresses, telephone and mobile numbers, and e-mail addresses.

4. Lawfulness of the Processing

Art. 6, Para. 1a of the EU General Data Protection Regulation (GDPR) is the legal basis for processing for which I obtain the consent of the data subject to the processing of his or her personal data for a specific purpose.

If the processing of personal data is necessary for the performance of a contract or fulfilment of an order, the legal basis for the processing is Art. 6, Para. 1b of the GDPR. This also applies to processing necessary for preparatory actions prior to conclusion of a contract, for example in response to enquiries or requests for quotations for my services.

Should I be subject to legal obligations which necessitate the processing of personal data, for example for fulfilment of tax-related obligations, the processing is based on Art. 6, Para. 1c of the GDPR.

Processing can also be based on Art. 6, Para. 1f of the GDPR. This is the legal basis for processing not covered by any of the above-listed legal bases, for pursuance of my legitimate interests or those of a third party, to the extent that such interests are not overridden by the interests or fundamental rights and freedoms of the data subject. A legitimate interest can normally be assumed if the data subject is one of my customers.

Should the processing of personal data be based on Article 6, Para. 1f of the GDPR, my legitimate interest is the performance of my business activity.

5. Categories of Recipients to Whom the Data May Be Disclosed

Financial services providers (e.g. credit agencies, debt collection agencies), my own lawyers and lawyers of opposing parties.

Otherwise I only provide data to public authorities and third parties in accordance with statutory regulations or a court order. Information can be provided to public authorities based on a statutory regulation for averting danger or for criminal investigations. Information is only provided to third parties when required by a statutory regulation, e.g. in the case of copyright violations.

6. Transfer of Personal Data to Third Countries or International Organisations

No personal data is transferred to third countries or international organisations.

7. Duration of the Data Storage

The criterion for the period for which personal data are stored is the respective statutory retention period. On expiry of that period the corresponding data are deleted on a routine basis, if no longer necessary for initiation or fulfilment of a contract.

8. Your Rights

a) Right of access
You have a right, in accordance with Art. 15 of the GDPR, to obtain information from me, free of charge, in respect of the personal data concerning you which I process.

b) Right to rectification
You have a right, in accordance with Art. 16 of the GDPR, to rectification of inaccurate personal data concerning you.

c) Right to erasure
You have a right, in accordance with Art. 17 of the GDPR, to demand erasure of personal data concerning you.

d) Right to restriction of processing
You have a right, in accordance with Art. 18 of the GDPR, to demand restriction of the processing of personal data concerning you.

e) Right to data portability
You have a right, in accordance with Art. 20 of the GDPR, to receive the personal data concerning you, and which you have provided to me, in a structured, commonly used and machine-readable format.

f) Right to object
You have a right, in accordance with Art. 21 of the GDPR, to object to the processing of personal data concerning you which is based on Art. 6, Para. 1e or 1f, of the GDPR.

g) Right to withdraw your consent to processing
You have a right, at all times, to withdraw any consent you may have given to processing of personal data concerning you for a specific purpose.

g) Right to lodge a complaint
Any complaints can be addressed to me directly at any time (via the contact data in Section 1 above).
You also have a right, in accordance with Art. 77 of the GDPR, to lodge a complaint with a supervisory authority.

9.    Changes to this Data Protection Statement

I reserve the right to amend this Data Protection Statement at any time with effect for the future. The latest version is available on the website www.RobertKerns.de. 

10.   Other Languages

This Data Protection Statement was originally written in German and then translated into English. In the case of inconsistencies between the German and English versions, the original German document shall take precedence.
